Unless otherwise specified, all references to site include any software that Sehat Kahani provides to you that allows you to access the site from a mobile device (a mobile application). By using this site, you are agreeing to all the policy; if you do not agree with any of these terms, do not access or otherwise use this site or any information contained on this site.

What we do:

• Our services are provided through the websites as above (which include mobile applications), is a telemedicine online solution that allows medical professionals and health care staff (healthcare providers or providers) to connect with their clients (patients) virtually, providing them quality clinical care and perform virtual real time consultations via a secure internet connection (the services).

• The services are intended for use by health care providers and patients in connection with active patient monitoring so as to allow immediate clinical action or continuous monitoring by a health care provider or the patient.

• Use of our services is not appropriate for emergencies like

  • Deranged level of consciousness

  • Severe hypo/hypertension

  • High grade fever affecting the sensorium

  • Shortness of breath

  • Cyanosis

  • Severe excruciating pain

  • Seizures

  • Bleeding/ injury/ burns

  • And all those conditions which require emergency care or physical assessment by a Physician, please go to the nearest tertiary care facility.

• To the extent medical advice is provided to you by a health care provider through the services, such medical advice is based on your personal health data as provided by you to the health care provider and the local standards of care for your presenting symptoms, based on the information you provide. The medical advice provided by your healthcare provider is not under the control of Sehat Kahani, nor is it provided to or used by Sehat Kahani, the company.

• All your protected health information maintained by Sehat Kahani, including information you provide on the App, is also subject to Privacy Rule under the Health Insurance Portability and Accountability Act (‘HIPAA’).

Sehat Kahaniis committed to protecting the privacy of the users of the Sehat Kahani App and will use and disclose your personal information as stated in this Privacy Statement. By using this telemedicine service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

App & Web Privacy Statement

Use and disclosure of health information includes, using the information to provide management and prevention guidance to the individual with chronic disease, and to conduct data analytics to improve the telemedicine experience. Our use and disclosure of an individual's personal information (including health information) is limited as required by state law. We do not sell or rent personal information about visitors to the Sehat Kahani App.

Security

The Sehat Kahani App has security measures in place that are intended to help protect against the loss, misuse, unauthorized access or alteration of information under our control. These measures include encryption of data during transmission using the Secure Socket Layer (SSL) system, encryption of data at rest, using a secured messaging service, and a secured transfer of data to the App. Despite these measures, the confidentiality of any communication or material transmitted to or from us via the Sehat Kahani App by Internet, text message, or email cannot be guaranteed. At your discretion, you may contact us at the mailing address or telephone number listed in the "Contacts" section at the end of this Privacy Statement.

License limitation, sharing and confidentiality

Community Innovation Hub Pvt. Ltd. (privately registered name) is, unless otherwise stated, the owner of all the copyright, trademark, patent, trade secret, database and other proprietary rights to the information including without limitation, the Sehat Kahani App. Without limitation of the foregoing, we assert ownership of a copyright in the entire system, including without limitation, the Sehat Kahani App, as a collective work and/or compilation, and in the selection, coordination and arrangement of the information and content in the Sehat Kahani App.

Chat Confidentiality

Sehat Kahani App will only contain information for the quality and monitoring purposes for the management and prevention of chronic diseases. All the information shared (either logged in or via chat feature) on the Sehat Kahani App will remain confidential. Any review or discussion, or use of this information is strictly prohibited. However, in case of any case of malpractice or misbehavior, the organisation is authorized to access the chat and transcripts of the session or user.

App visitor data

In addition to web logs, described below, Sehat Kahani routinely gathers data from the App activity, such as how many people visit the site, the web pages or mobile screens they visit, what workflow they follow, how long they stay on each page, the exchange of messages between the users etc. The data is collected on an aggregate, anonymous basis, which means that no information is personally identifiable or is associated with the data. This data collected helps Sehat Kahani to improve content and overall usage. The information is not shared with any other organizations for their independent use.

The Sehat Kahani App does not honour a browser’s signal or header request to track the user's activity.

Collecting and using and disclosing personal information

As disclosed in this Privacy Statement, we do not collect any personally identifiable information about users to the Sehat Kahani Apps.

We collect the following personal information from you:

• Contact information such as name, email address, mailing address, and phone number

• Age or date of birth

• Address, State, Province, Postal code, City

• Cookies and Usage Data

• Unique identifiers such as user name, and password

• Preferences information such as preferred first name and the types of emails you’d like to receive from Sehat Kahani App

• Health or medical information

We use and disclose your information to:

• Communicate your health information, or the health information of someone you are caring for, to health care providers treating you.

• Communicate to you the health information of others you are authorized to act on behalf of on the Sehat Kahani Apps

• Respond to any queries sent to practitioners via chat feature.

• Monitor your account

• Respond to your health-related questions and concerns

• Improve Sehat Kahani App, and marketing efforts

• Conduct data analytics based on de-identified patient health information

• Provide and maintain our Service;

• Notify you about changes to our Service;

• Allow you to participate in interactive features of our Service when you choose to do so;

• Provide customer support;

• Gather analysis or valuable information so that we can improve our Service;

• Monitor the usage of our Service;

• Detect, prevent and address technical issues;

• Fulfill any other purpose for which you provide it;

• Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;

• Provide you with notices about your account and/or subscription, including expiration and renewal notices, email-instructions, etc.;

• Provide you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information;

• In any other way we may describe when you provide the information;

• For any other purpose with your consent.

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link.

2. Server logs

We maintain a standard server that records data about all users who use the Sehat Kahani App and we store this information. These logs may contain the internet domain from which you access the site, the IP address which is automatically assigned to your computer when you get on the Internet (a static IP address may be identifiable as being connected to you, while a dynamic address is usually not identifiable); the type of browser and operating system you use; the date and time you visited; the pages or mobile screens you viewed; and the address of the App you linked from, if any. All web logs are stored securely, and may only be accessed by Sehat Kahani employees or designees on a need-to-know basis for a specific purpose. Sehat Kahani uses server information to improve the design of Sehat Kahani Apps ; to identify popular features; to resolve user, hardware, and software problems; to make the Sehat Kahani Apps more useful to users for security purposes.

When you access Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

3. Disclosures

• We may disclose personal information to any person performing audit, legal, operational, or other services for us. We will use information which does not identify the individual for these activities whenever reasonably possible. Information disclosed to vendors or contractors for operational purposes may not be re-disclosed to others by such a vendor or contractor, except as permitted by the Sehat Kahani App and the Applicable law. We may also disclose your personal information:

• as required by law, such as to comply with a subpoena, or similar legal process

• as described in the Privacy Rule for protected health information

• when we believe in good faith that disclosure is necessary to protect our rights, protect you or others from threats of imminent harm, investigate fraud or other activity in violation of the law, or respond to a government request

• to protect the security and reliability of the App

• if Sehat Kahani App is involved in a merger, acquisition, or sale of all or a portion of its assets. You will be notified via email and/or a prominent notice on our App of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information

• to any other third party with your prior consent to do so Other cases. We may disclose your information also:

• To our subsidiaries and affiliates;

• To contractors, service providers, and other third parties we use to support our business;

• To fulfill the purpose for which you provide it;

• For the purpose of including your company’s logo on our App;

• If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others.

• If we or our Subsidiaries are involved in a merger, acquisition or asset sale, your personal data might be transferred

4. Other requests to limit use and disclosure of your personal information

State law may allow you to request that we limit our uses and disclosures of your personal information for treatment, payment, and health care operations purposes. We will consider all requests and, if we deny your request, we will notify you in writing. State law requires us to agree to your request to restrict disclosures to a health plan or insurer relating to specific health care services, if you have paid for those services in full. The law does not, however, require us to restrict any disclosures we think are important for treatment purposes.

5. Data retention

We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

6. Transfer of Data

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. If you are located outside Pakistan and choose to provide information to us, please note that we transfer the data, including Personal Data, to Pakistan and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

7. Security of Data

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure, encrypted on Microsoft Azure, a leading cloud service. However, while we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security if you were to risk the information at your own end by providing access to users others than yourself.

8. Service Providers

We may employ third party companies and individuals to facilitate our Service (Service Providers), provide Service on our behalf, perform Service-related services or assist us in analysing how our Service is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

1. Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service.

2. CI/CD tools

We may use third-party Service Providers to automate the development process of our Service.

3. Login

We have offered the login with Facebook or login with Google option so patients & doctors do not have to create a new username and password specifically for this portal. When they choose to login with Facebook, Facebook shares full name, profile picture and email address. When they choose to login with Google, Google shares full name and email address. No health data is shared back to Facebook or Google, as mentioned in the Facebook terms and Google terms.

4. Payment Gateway

We have partnered with third party payment vendors and integrated their gateways.

9. Links to Other Sites

Our Service may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

10. Children's Privacy

Our Services are not intended for use by children under the age of 18 ( Child or Children ) without the presence of a guardian. We do not knowingly collect personally identifiable information from Children under 18. The physician is instructed to report any account created by a Child where he/she has provided us with Personal Data, to us. If we become aware, directly, that we have collected Personal Data from Children without verification of parental consent, we take steps to remove that information from our servers.

11. Payments

• By registering for an account with Sehat Kahani, you become a registered user with access to certain password-restricted areas of the site and to use certain services and materials offered on and through the site (a subscription). Each subscription and the rights and privileges provided to a registered user is personal and non-transferable. All sales and payments of subscription fees will be in us Pakistani Rupee (PKR). All subscription fees are non-refundable under any circumstances.

• Sehat Kahani reserves the right to change prices for subscriptions at any time, and does not provide price protection or refunds in the event of promotions or price decreases. Notwithstanding the foregoing, Sehat Kahani shall notify registered users of any price changes thirty (30) days prior to any change. Sehat Kahani shall honor any subscription prices until the expiration of the applicable subscription term.

• The Services will be provided against pre-payment by patient, without any right of set-off, deduction or counterclaim, to the extent, and for as long as, Customer is in credit. Customer will pre-pay the Services using the options provided via the third party payment gateway integrated in the App. Furthermore, the third party is solely responsible for any use or misuse of data that is limited to the gateway or miscellaneous funds related operational concerns regarding the gateway and its functionality.

12. Accessing or Modifying Your Account Information

You can use the Sehat Kahani App and self-register to create a new account. Your Login Credentials. You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities that occur with your credentials. You agree to notify Sehat Kahani immediately if you believe the confidentiality of your login credentials has been compromised or if you suspect unauthorized use of your account. You agree that we will not be liable for any loss or damage arising from unauthorized use of your credentials.

13. Location-Based Services

Some of the features of the Sehat Kahani App may access your location in order to personalize your experience with the App based on your location (‘Location-Based Services’). In order to use certain Location-Based Services, certain features of your mobile phone must be enabled, such as GPS, Wi-Fi, and Bluetooth, which enable Sehat Kahani App to identify your location through a variety of means, including GPS location, IP address, cell tower location, geo-fencing technology, or detection by physical on-location Wi-Fi, as available. By enabling Location-Based Services on your device, you agree and acknowledge that (a) device data Sehat Kahani App collects from you is directly relevant to your use of the App, (b) Sehat Kahani App may provide Location-Based Services related to and based on your then-current location, and (c) Sehat Kahani App may use any information collected in connection with the provision of Location-Based Services in connection with its provision of the App.

14. Communications - Consent to Receive Email/Phone Communications

You agree to receive alerts in the form of emails, SMS and phone calls from Sehat Kahani at the contact details i.e. email address & contact number you provided to us during sign up. These alerts include customer service-related and promotional purposes and in connection with providing communications that are features of the Sehat Kahani App (e.g., information on new products or features, informational notifications, and motivational alerts). You agree to receiving such alerts during the active period of your account. In connection with your use of the Sehat Kahani App, you understand and acknowledge the following:

1. There is certain security, corruption, transmission error, and access availability risks associated with using open networks and you hereby expressly assume such risks.

2. You are responsible for the data security of the mobile or laptop(systems) used to access the Sehat Kahani App and for the transmission and receipt of information using these mediums.

3. You have requested access to the Services, made your own independent assessment of the adequacy of the Connections and Systems, and are satisfied with that assessment.

4. We are not responsible for any errors or problems that arise from the malfunction or failure of your connection or the system being used.

5. We may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the App. If we learn of a security systems breach, we may attempt to notify you electronically by posting a notice via Sehat Kahani App or sending an alert to you.

15. Sehat Kahani’s Copyright

The contents of the Sehat Kahani App include designs, text, graphics, images, video, information, logos, button icons, software, audio files, computer code, and educational information. All content and the compilation (meaning the collection, arrangement, and assembly) of each component is the property of Sehat Kahani and is protected under copyright, trademark, and other laws.

16. Intellectual Property Rights and Our License to Use

The Sehat Kahani App may include features that enable you to post certain materials from your device to the App. Except for telemedicine services provided to you on or through the App, you agree that you, solely, are responsible for, and assume all liability and consequences regarding the photos, video, audiovisual, audio, text, and any other media content that you post to or through the Sehat Kahani App along with all associated metadata (which may include, without limitation, your device type, Applicable device identifier, IP address, phone state, as well as date, time, and Application and location data associated with Internet and data services and the creation or submission or a particular piece of content) (collectively ‘Your User Content’).

1. You Acquire No Ownership of Others’ Content. You understand and agree that you will not obtain, through use of the Sehat Kahani App, any right, title, or interest (including intellectual property rights) in content delivered via the App. Consent to Use of Data.

2. You agree that Sehat Kahani may collect and use technical data and related information, including, but not limited to, unique device identifiers and other technical information about your device, system and Application software, and peripherals that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Sehat Kahani App, and to track and report your activity inside of the App, including for analytics purposes.

17. Intellectual Property Policy

Sehat Kahani respects the intellectual property of others and takes the protection of copyrights and all other intellectual property very seriously, and we ask our users to do the same. Infringing activity will not be tolerated on or through the Sehat Kahani App. Sehat Kahani’s ntellectual property policy is to (a) remove material that it believes in good faith, upon notice from an intellectual property owner or their agent, is infringing the intellectual property of a third party by being made available through the Sehat Kahani App, and (b) remove any User Content posted to the Sehat Kahani App by ‘repeat infringers’. Sehat Kahani considers a ‘repeat infringer’ to be any user that has posted User Content to the Sehat Kahani App and for whom Sehat Kahani has received more than two takedown notices compliant with respect to that User Content.

Sehat Kahani has discretion, however, to terminate the account of any User after receipt of a single notification of claimed infringement or upon its own determination.

18. Consequences of Violating the privacy policy

We reserve the right to suspend or terminate your account and prevent access to the Sehat Kahani App for any reason, including if you engage in activity that, in the organisation’s sole judgment, violates this privacy policy, without notice and at our discretion. We reserve the right to refuse to provide services on the Sehat Kahani App or any portion thereof to you in the future. We may block or prevent your future access to and use of the Sehat Kahani App or any portion thereof.

We are authorized to review and remove any User Content at any time for any reason, including if you engage in activity which, in Sehat Kahani’s sole judgment: violates this privacy policy; violates Applicable laws, rules, or regulations; is abusive, disruptive, offensive, or illegal; or violates the rights of, or harms or threatens the safety of, users of the Sehat Kahani App. You are responsible for any claims, fees, fines, penalties, and other liability incurred by us or others caused by or arising out of your breach of this privacy policy and your use of the Sehat Kahani App. You are solely responsible for maintaining backup copies of any User Content you post to the Sehat Kahani App.

19. For Doctors or Medical Professionals

If you are a doctor or medical professional registering on this App, by enrolling in or using this service, you hereby confirm that usage is at your own risk and you release and agree to hold harmless the providers, developers, deployers from liability for adverse consequences, including but not limited to claims, actions or legal proceedings by third parties, loss or breach of any private data and/or damages suffered as a result thereof.

20. Indemnification

You agree to defend, indemnify and hold harmless Sehat Kahani, its telemedicine platform, its medical practitioners, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these privacy policy for your use of the App, including, but not limited to, Your User Content, any use of the App’s / App’s content, services and products other than as expressly authorized in these privacy policy for your use of any information obtained from the App.

21. Data Deletion Policy

If users want to get their data deleted - they can contact to our 24/7 helpline and ask for deletion of data. We have provision of removing user's data from a secure super-admin portal which can be accessed by authorised personnel only. Details of helpline are provided at the end of this document.
